Vitoqa Terms of Use
Last updated: 23 August 2026. These Terms apply to your use of the Vitoqa platform and services. By completing the account setup process or continuing to use the Service, you agree to these Terms.
1. The Service
Vitoqa provides an online event invitation and RSVP platform that enables event organisers to create personalised digital invitations, manage guest lists and collect RSVP responses (the “Service”). Vitoqa may update or change the features of the Service from time to time.
2. Your account
You are responsible for keeping your account credentials secure and for all activity that takes place under your account. Do not share your login details with others.
Please notify us promptly at contact@vitoqa.com if you believe your account has been compromised or accessed without authorisation.
3. Event organiser responsibilities
As an event organiser using the Service, you are responsible for:
- the accuracy, completeness and lawfulness of any event information, guest information and content you upload or provide through the Service;
- ensuring you have the rights or permissions necessary to share any content or personal information of guests with Vitoqa;
- complying with applicable data protection, privacy and other applicable law in relation to the guest information you supply and manage; and
- how you use the Service in connection with your events and guests.
4. Acceptable use
You may use the Service only for its intended purpose and in accordance with these Terms and applicable law. You must not:
- use the Service to send unsolicited messages, spam or material that is harassing, offensive, discriminatory or illegal;
- attempt to gain unauthorised access to the Service, its underlying systems or another user’s account;
- upload or transmit malware, viruses or any other harmful code or content;
- use the Service in a way that infringes any intellectual property right or other third-party right;
- misrepresent your identity or affiliation; or
- use the Service in any way that places an unreasonable burden on the platform or interferes with its operation.
5. Guest personal data
Where you, as an event organiser, provide or manage personal information about your guests through the Service, you determine the purpose and manner of that processing. Vitoqa processes that information to provide the Service on your behalf. Further detail is set out in the Data Processing section below and in our Privacy Notice.
6. Data processing
Where Vitoqa processes personal data about your guests in providing the Service, it does so only on your documented instructions (provided through your use of the Service’s features and these Terms). Vitoqa will:
- process guest data only to provide the Service and in accordance with these Terms;
- keep such data confidential and require the same of any personnel with access to it;
- implement and maintain appropriate technical and organisational security measures;
- only engage sub-processors that provide sufficient data-protection guarantees, and inform you of any intended change to sub-processors where required by applicable law;
- assist you with reasonable requests to exercise data subject rights where Vitoqa is able to do so given the nature of the processing;
- on the termination of the Service, delete or return personal data as reasonably practicable, unless applicable law requires Vitoqa to retain it; and
- make available reasonable information to assist with your compliance obligations on request.
Sub-processors used to deliver the Service include infrastructure and email delivery providers. Further information about sub-processors is available on request at contact@vitoqa.com.
7. Intellectual property
Vitoqa retains all intellectual property rights in the platform, software and associated materials. You retain ownership of the content you provide through the Service. By using the Service, you grant Vitoqa a limited licence to store, process and display that content solely for the purpose of providing the Service to you. That licence ends when you stop using the Service or delete the relevant content, subject to any retention required by law or these Terms.
8. Service availability
Vitoqa aims to provide a reliable and available service but does not guarantee uninterrupted or error-free access. The Service may occasionally be unavailable due to scheduled maintenance, updates or circumstances beyond Vitoqa’s reasonable control. Vitoqa will aim to give advance notice of planned maintenance where reasonably practicable.
9. Pilot and complimentary access
Vitoqa may provide pilot or complimentary access to the Service. The following terms apply to such access:
- Pilot or complimentary access does not create a permanent or unlimited entitlement to any features, usage level or pricing.
- Vitoqa may introduce commercial plans, pricing or usage limits that differ from any access provided during a pilot or complimentary period.
- Vitoqa will not remove or materially change pilot or complimentary access without reason. Where Vitoqa intends to make a material change — such as introducing commercial pricing or a significant reduction in features or limits — Vitoqa will aim to give reasonable advance notice to allow you to make alternative arrangements.
- Nothing in this section affects Vitoqa’s right to suspend or terminate access for the reasons set out in the Suspension and Termination section.
10. Suspension and termination
Vitoqa may suspend or terminate your access to the Service if:
- you seriously or repeatedly breach these Terms;
- you use the Service for illegal purposes or in a manner that creates a material security risk;
- your account is involved in abuse of the Service or activity harmful to other users; or
- Vitoqa is required to do so by law or a regulatory authority.
Where reasonably practicable, Vitoqa will give advance notice before suspension or termination, unless immediate action is required to protect the Service or other users. You may also stop using the Service at any time. On termination, Vitoqa will handle personal data consistently with the Data Processing section above.
11. Limitation of liability
Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability for fraud, for death or personal injury caused by negligence, or any other liability that applicable law does not permit to be excluded.
Subject to the above and to the extent permitted by applicable law, Vitoqa will not be liable for indirect, incidental, special or consequential loss or damage arising from your use of the Service. Where Vitoqa’s liability is not otherwise excluded, it will be limited to the amount you have paid to Vitoqa in the twelve months before the event giving rise to the claim (or, where no amount has been paid, a nominal sum).
12. Changes to these Terms
Vitoqa may update these Terms from time to time. For material changes, Vitoqa will provide reasonable advance notice — for example by email or by a prominent notice within the Service — and will ask you to confirm acceptance of the updated Terms before you continue to use the Service. Minor or non-material changes, such as clarifications or corrections, may take effect without formal notice. The current version of these Terms is always available at vitoqa.com/terms/.
13. Governing law
These Terms are governed by the law of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. Where you are a consumer, mandatory consumer-protection provisions of the law of your country of residence may also apply and are not affected by this clause.
